As the pandemic drags on, lawyers and judges are starting to confront questions about how to administer justice in a world that’s gone virtual. We’re devoting two Legal Speak podcasts to exploring the issues. In this episode, Cooley global litigation chair Michael Attanasio talks with Law.com California bureau chief Alaina Lancaster about what gets lost in a virtual proceeding—and explains the one thing that would compel him to give it a try. Attanasio is a former federal prosecutor and a fellow in the American College of Trial Lawyers. Among other concerns, he says that virtual proceedings would fundamentally change advocacy and could exclude jurors who don’t have access to the needed technology.
